An article in Chiroeco.com on June 11, 2014, tiltled “ACA presses HHS to aggressively enforce provider non-discrimination law,” describes the continuing battle that the chiropractic profession has to wage to make sure that all patients have access to the provider of their choice under the intent of Congress when they passed they Patient Protection and Affordable Care Act.

Some states have used the flawed and ambiguous information in the Frequently Asked Questions on Section 2706 as a way to limit patient access to qualified health care providers, including chiropractic physicians, based solely on the type of license that have.

The Senate Committee on Appropriations stated “the goal of this provision is to ensure that patients have the right to access covered healthcare services from the full range of providers licensed and certified in their state” and have supported a revision of the FAQ on Section 2706.

According to the American Chiropractic Association they fell that changes will be taken to “clarify” and/or replace the flawed FAQ language by the end of this year. Until that happens they will remain vigilante and continue to campaign to ensure the correct implementation of Section 2706
